TEMPORARY FURNISHED RENTING CONTRACT

Article 1 : Renting out object :
The taker rents one of the two furnished rooms of 10,2 m2, located in Château Double , Bt.2 , 3rd stage, for the monthly lump sum of :
398 €. payable before the 5th day of each month, for the period from ___/___/_________ber 2010 to June the 30th 2011 à on midday.This amount includes the charges and the use of furniture, for an amount of 155 €. ,
except electricity which is due moreover, according to raised consumption. A monthly certificate of payment will be provided to the taker.
Beyond June 30th at midday, if housing were still occupied, the monthly temporary hiring would become a dayly one at the price of : 57 €. per day, payable in advance.
In case of nonpayment at the date of the 5th of each month, a penalty of 70 €. will be applied per started week of delay. The lease will be cancelled automatically after three weeks of delay and the taker will have to leave the place the 23th at midday of the month not payed. Damages could then be requested from the taker, for abusive rupture of leasing..
The taker can use the bathroom, the hall and the W.C. (sharing them with the possible taker of the other room), excluding any other part of the flat, except particular agreement. He has the access and the use of the kitchen according to particular rules of the appendix of this contract.
These places represent 33 m² (that he shares partly, if necessary, with the occupant of the other room).
The taker can use the terrace (25 m²) acceding only by the French window of the kitchen.
The taker is an alone person who does not smoke. If, in exceptional circumstances another person would come to place with the taker, this one is committed indicating it to the hirer out, by specifying the identity of the guest because the hirer must inform the other room's taker about it.

Article 2: Use:
The taker undertakes to take care of the maintenance of the parts placed at his disposal, like with their good conservation (closing with its departure). A vacuum cleaner will be available for this purpose. The taker will not move the furnitures and will not make installations without the hirer agreement. The household linen is not provided (cloths, covers, bathroom linen...). The taker commits himself to respect the rules of joint ownership (annexed), and, in particular, not making noise between 10 hours PM and 8 hours AM. Any fire of any kind is prohibited (matches, candles, stove, heating-dish, cigarettes...). The taker will not be able to have any domestic animal in the apartment. He will not be able to store any flammable gas and must not fix anything on the walls (posts, poster, photographs, postcards, and so on...). Except after request to the hirer, the taker will not be able to receive more than two persons at the same time who, in all cases, will have to leave the place at the latest at 10 p.m. and not to arrive on the morning before 8 a.m.. The taker will not move the furnitures and will not install their own furnitures without the previous agreement of the hirer. An inventory will be made at the entry in the flat. The 5 keys (hall, alarm, room, letter box and building's entry) will be given to the taker and will be returned when leaving. The key of the bicycles'garage is available, if needed. The taker promises not making any copy of these keys, nor to communicate the key-code of entry of the building to other persons. The hirer preserves, only occasionaly, a free access to the terrace, the living room and the kitchen so as to read the consumption of the electric meter..

Article 3: Insurance:
In accordance with paragraph 12, page 56 of the joint ownership rules, the taker has to ensure his risks of hiring and its civil liability with regard to the other joint owners for the building and will provide a certificate to the hirer out.

Article 4: Guarantee deposits:
A guarantee deposit of a two months amount, charges included, will be made, by cheque, by the taker, to guarantee any degradation or any non-payment. A deposit of an amount of 80 €. will be made, by cheque, by the taker, to guarantee cleanliness, at the end of the hiring. A deposit of an amount of 90 €. will be made, by cheque, by the taker, with the handing-over of the remote control opener of the residence. The hirer promises not cash them, until the departure of the taker, except fault of payment within the time allowed. CThese cheques of deposit will be integraly given back to the hirer out, after inventory of fixtures to its departure, if no degradation is noted, if the remote control is returned in working order and if the place is made as clean as entering the place. In the contrary case, the amount of repairs or cleaning (minimum fixed amount of 20 €. ) will be deduced from these deposits. |

Article 5: Electricity (E.D.F.):
The methods of share in the expenses of EDF are specified in appendix.

Article 6: Cancellation:
The contract is terminated automatically at the limit from June 30th at midday. The hirer out can immediately terminate the contract in case of non-observance of this contract, meant in writing. He is then founded to ask damages covering the hiring until his term, except loads. The taker will have to make the inventory of fixtures, to cancel any contract which it would have subscribed (telephone, subscription with newspapers, bank etc...) and to carry out a change of address at the post office, the hirer out not making follow the mail received after the departure of the taker. The taker can stop the contract from May 31th, with an at least 'one month notice'. Before this date, the amount of the rents until May 31th remains due to its departure (except charges). |

Article 7: Justification of identity and needed documents:
The taker will provide a photocopy of his/her student card and of his/her identity document, a certificate of payment-jointure guarantee with the latest 3 payment bills and the photocopy of this person who guarantees the payment and, according to the current legislation, the photocopy of his/her long stay visa or a certificate of authorization of residence on the French territory for a taker of foreign nationality except European Union or Iceland, Liechtenstein, Norway or Switzerland.

Article 8: Dispute:
In the event of dispute, the competent jurisdiction court is that of Aix en Provence.
